Terms of Service

Definitions

• "Service": the Fintello web application accessible at fintello.app
• "User" or "You": any individual using the Service
• "Account": the personal space created upon registration
• "Space": a workspace that can be shared between multiple members
• "Content": all data entered by the User (accounts, transactions, budgets, etc.)

Acceptance of Terms

By creating an account or using Fintello, you declare that you have read, understood, and accepted these Terms of Service as well as our Privacy Policy. If you do not accept these terms, you must not use the Service. These Terms constitute a contract between you and Fintello.

Service Description

Fintello is a personal finance management application that allows you to:

• Track your bank accounts, transactions, and budgets
• Interact with an AI assistant to analyze your finances and get advice
• Share a space with other members (family, couple)
• View charts and statistics about your financial habits
• Manage your recurring subscriptions

The Service is provided "as is" and may evolve over time. We reserve the right to add, modify, or remove features.

Account Creation and Responsibilities

To use Fintello, you must create an account. You agree to:

• Provide accurate and up-to-date information when registering
• Keep your password confidential and not share it
• Notify us immediately of any unauthorized access to your account
• Be at least 18 years old or have authorization from a legal representative
• Not create multiple accounts or transfer your account to a third party

You are solely responsible for all activities carried out from your account.

Acceptable Use

By using Fintello, you agree not to:

• Use the Service for illegal or fraudulent purposes
• Attempt to harm the Service, its infrastructure, or other users
• Disassemble, decompile, or reverse engineer the software
• Use unauthorized robots, scrapers, or automated scripts
• Collect or store personal data of other users
• Transmit viruses, malware, or any malicious code
• Circumvent security measures or Service limitations

Intellectual Property

Fintello and all its elements (logo, design, source code, texts, graphics) are protected by copyright and belong to Fintello or its licensors. You are granted a limited, personal, non-exclusive, non-transferable, and revocable license to use the Service in accordance with these Terms.

You retain ownership of your Content. By adding it to the Service, you grant us a limited license to store, process, and display it for the purpose of providing the Service.

Limitation of Liability

To the extent permitted by law:

• We do not guarantee the accuracy of calculations, analyses, or AI suggestions. You are responsible for verifying your financial data.
• We strive to ensure 99.9% availability but do not guarantee uninterrupted operation. Maintenance may cause interruptions.
• Fintello cannot be held liable for indirect, incidental, special, or consequential damages, including loss of data or profits.
• We are not responsible for third-party services (banks, Stripe, etc.) that the Service may connect to.
• Our total liability is limited to the amount you have paid for the Service in the last 12 months.

Subscriptions and Payments

Fintello offers free and paid plans:

• Available plans: Free, Plus, and Pro (paid)
• Paid subscriptions are billed monthly or annually, according to your choice
• Subscriptions renew automatically at the end of each period
• You can cancel at any time from settings. Cancellation takes effect at the end of the current period
• Prices may be changed. Any change will be notified to you 30 days in advance
• Prices shown are exclusive of tax. Applicable VAT will be added at checkout

Right of Withdrawal

In accordance with consumer protection laws, you have 14 days from subscribing to a paid plan to exercise your right of withdrawal, without having to justify reasons. To exercise this right, send an email to legal@fintello.app. In case of withdrawal, we will refund you within 14 days.

If you have started using the Service before the end of the withdrawal period, you acknowledge waiving this right for the period started.

Termination

You can delete your account at any time from settings. Deletion results in permanent erasure of your data within 30 days.

We reserve the right to suspend or delete your account in case of violation of these Terms, fraudulent activity, or prolonged inactivity (24 months), after 30 days prior notice except in emergencies (security, legal obligation).

Modifications to Terms

We may modify these Terms at any time. Substantial changes will be notified by email or in-app notification at least 30 days before they take effect. Continued use of the Service after that date constitutes acceptance of the new terms. If you do not accept the changes, you must stop using the Service and delete your account.

Governing Law and Disputes

These Terms are governed by French law. In case of dispute, we invite you to contact us first to find an amicable solution.

In accordance with French consumer protection law (Article L612-1), you may use a consumer mediator free of charge in case of dispute. A mediator will be designated before the commercial launch of the service. In the meantime, you can contact us at legal@fintello.app for any complaint.

Failing amicable resolution, French courts will have jurisdiction, subject to mandatory consumer protection provisions of your country of residence.
